Does the Petitioner have the right to control the work of the Beneficiary on a day-to-day basis if such control is required?

Engr. Shaun Nwokoro is our full – time employee and by the terms and conditions of his contract, we have the right to control the work that he does for us and we ensure that we do it on a day – to – day basis.

Does the Petitioner provide the tools or instrumentalities needed by the Beneficiary to perform the duties of employment?

Every tools and instrumentalities needed by Engr. Shaun Nwokoro are provided by Silver Lining® Cloud Computing, Inc. as stipulated in our employee’s handbook and the letter of employment.

Does the Petitioner hire, pay, and have the ability to fire the Beneficiary?

Yes. Silver Lining® Cloud Computing, Inc. hires, pays, and has the ability to fire Engr. Shaun Nwokoro. Silver Lining® Cloud Computing, Inc. will provide full employment benefits to Engr. Shaun Nwokoro. His benefits will be governed and managed by Silver Lining® Cloud Computing HR department and includes: Health / Life Insurance, AD&D, Dental, Vision, Paid Vacations, 401(k), amongst other benefits.

Does the Petitioner claim the Beneficiary for tax purposes?

Yes. Silver Lining® Cloud Computing, Inc. will claim Engr. Shaun Nwokoro for tax purposes. Engr. Shaun Nwokoro ’s payroll and other taxes will be governed by applicable State and Federal laws including Income Tax.

Does the Beneficiary use proprietary information of the Petitioner in order to perform the duties of employment?

Yes. Silver Lining® Cloud Computing, Inc. maintains a unique and proprietary that efficiently implements and delivers cloud computing projects. Silver Lining® Cloud Computing, Inc. methodologies are audited for compliance by independent Auditors.

Our organization is under the regulation of the federal regulating body. Engr. Shaun Nwokoro will be required to follow these proprietary processes and policies in this position. Does the Petitioner have the ability to control the manner and means in which the work product of the Beneficiary is accomplished?

The nature of our business gives us the capacity to maximize all the communication channel with Engr. Shaun Nwokoro especially as it relates to the work product and target that needs to be archived from the project at a high-level.

It provides the broad guidelines and framework within which the implementation must be done. This includes specifying broad parameters like timelines, business problem definition, technologies, methodologies that need to be used. Silver Lining® Cloud Computing, Inc. then monitors, advises and guides Engr. Shaun Nwokoro to ensure that he is on the right track and will be able to achieve the targets.
